Laws Designed to Prevent Driver Fatigue Accidents

There are more trucks on the road now than ever before. As more truck drivers take on longer routes, driver fatigue becomes a serious danger. In 2013, the maximum number of hours a truck driver could work in a week was reduced to 70 hours, down from 82. According to the Federal Motor Carrier Safety Administration, drivers are also required to take a 30-minute break during the first eight hours of a driving shift. Furthermore, drivers are also limited to an 11-hour driving limit per day and a 14-hour workday. There are penalties in place for drivers and companies that violate these rules.

Although the federal government has implemented regulations to limit the number of hours a truck driver can work during the week, accidents as a result of driver fatigue still occur. When this happens, the trucking company must be held accountable. If you were injured in an accident caused by a tired driver, you may be entitled to receive compensation.

In addition to fatigue, accidents can be caused by:

  • Driving while under the influence of drugs or alcohol
  • Negligence or recklessness on the part of the driver
  • Negligence on the part of the trucking company
  • Improper maintenance of equipment and vehicles
  • Inadequate driver training
